Service agreement

Terms of Service

These terms govern business and professional use of Enrike, including its website, playground, spreadsheet tools, API, integrations, and paid plans.

1. Provider and acceptance

Enrike is provided by Higuera Ex Machina SL, NIF B21770680, with registered address at C/Escultor Llimona 15, 08031, Barcelona, Spain (“Higuera”, “we”, “us”). Contact: enrike@higuera.ai.

By creating an account, selecting a plan, using an API key, or otherwise accessing Enrike, you agree to these Terms. If you act for an organisation, you confirm that you have authority to bind it.

2. Business eligibility

Enrike is offered for business and professional use. You must be at least 18 and use a business email address. You must not create an account or use the service as a consumer or on behalf of someone who has not authorised you.

3. The service

Enrike enriches business email addresses and postcodes with contextual fields. It supports manual lookup, browser-parsed CSV and XLSX files, REST API requests, and HTTP-based integrations such as Zapier, Make, and n8n. Features, speed, volume, webhooks, support, and other limits depend on the active plan.

We may improve, replace, or discontinue features. We will give reasonable notice where a material change substantially reduces a paid service during its current billing period.

4. Enrichment results

Enrichment results are estimates.

Results can be incomplete, outdated, or incorrect. Inferred professional, demographic, location, gender, age, language, and salary fields are not verified facts and require human review.

You must not use a result as the sole basis for a decision that produces legal or similarly significant effects, including employment, credit, insurance, housing, or eligibility decisions. Enrike is not a credit-reporting, identity-verification, background screening, or regulated decision-making service.

5. Accounts and credentials

  • Provide accurate registration and billing information.
  • Keep passwords, sessions, access tokens, and API keys confidential.
  • Restrict access to authorised users within your organisation.
  • Notify us promptly of suspected compromise or unauthorised use.
  • Remain responsible for activity performed through your account and credentials.

6. Customer data and data protection

You retain rights in data you submit and grant Higuera the limited right to process it as needed to provide, secure, support, and improve the contracted service in accordance with these Terms and the Privacy Policy.

You are responsible for ensuring that submitted data and your use of results are lawful; providing notices; establishing a valid legal basis; responding to data subjects; and avoiding special-category, criminal-conviction, children’s, or identity-document data unless expressly agreed. The Data Processing Agreement applies when Higuera processes personal data on your behalf.

7. Acceptable use

You must not:

  • submit or obtain data you are not legally permitted to process;
  • use Enrike for unlawful discrimination, covert surveillance, harassment, stalking, spam, deception, or rights violations;
  • use results to identify or infer sensitive traits for prohibited purposes;
  • bypass plan limits, rate limits, authentication, security, or access restrictions;
  • probe, disrupt, overload, introduce malware, scrape, reverse engineer, or interfere with the service except where law expressly permits;
  • resell, sublicense, or provide shared access to Enrike unless a written agreement allows it;
  • misrepresent an estimate as verified or Higuera-endorsed information.

8. API, files, and integrations

API and integration users must use the documented endpoint and authentication method, keep keys in secure credential storage, and respect published limits. We may throttle or reject requests that exceed plan, rate, payload, or security limits.

Spreadsheet files are parsed in the browser and supported values are submitted as individual enrichment requests. You are responsible for reviewing downloaded output and for securing files before and after processing. Third-party automation platforms are governed by their own terms and privacy practices.

9. Plans, payment, and cancellation

Current features, usage allowances, prices, billing periods, and applicable taxes are displayed before checkout. Paid plans renew automatically for successive monthly periods until cancelled. Stripe processes payments and provides the customer portal.

You can cancel through the customer portal. Unless checkout states otherwise, cancellation takes effect at the end of the current paid period and does not create a refund or credit for unused time. Failed payment may result in downgrade, restriction, or suspension. Taxes are your responsibility except taxes imposed on Higuera’s income.

We may change prices or plan limits prospectively with reasonable notice to active paid customers. Enterprise commitments, service levels, and custom terms apply only when agreed in a separate signed order or contract.

10. Intellectual property and feedback

Higuera and its licensors own Enrike, its software, interface, documentation, branding, models, workflows, and related materials. During the applicable plan, we grant you a limited, non-exclusive, non-transferable, revocable right to use the service internally in accordance with these Terms.

If you provide feedback, you allow Higuera to use it without restriction or payment, provided we do not identify you publicly without permission.

11. Confidentiality

Each party will protect non-public information received from the other using reasonable care and use it only for the service relationship. This does not cover information that is public without breach, already lawfully known, independently developed, or lawfully received from another source. A party may disclose information when legally required after giving notice where permitted.

12. Availability and third parties

We aim to provide a reliable service but do not guarantee uninterrupted, error-free, or loss-free operation. Enrike depends on hosting, authentication, payment, model, retrieval, search, and other third-party providers. Provider outages, public-source changes, and model behaviour can affect availability and results.

We may perform maintenance or suspend access where reasonably needed for security, legal compliance, provider restrictions, non-payment, or service integrity. Contractual service levels apply only where expressly agreed in writing.

13. Warranties and liability

To the maximum extent permitted by law, Enrike is provided “as is” and “as available”. Higuera disclaims implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Nothing excludes a warranty or liability that cannot legally be excluded.

Higuera is not liable for indirect, incidental, special, exemplary, or consequential loss; lost profits, revenue, goodwill, or data; or decisions made in reliance on enrichment results. Higuera’s aggregate liability arising from Enrike is limited to the amount paid by the customer for Enrike during the twelve months before the event giving rise to the claim. The limit does not apply where prohibited by law.

14. Suspension and termination

You may stop using Enrike or cancel a paid plan at any time. We may suspend or terminate access for material breach, unlawful use, non-payment, security risk, provider requirement, or legal obligation. Where practical, we will give notice and an opportunity to remedy a curable breach.

On termination, your right to use the service ends. Accrued payment obligations and provisions that by nature should survive—including confidentiality, intellectual property, disclaimers, liability, and governing law—remain effective.

15. Changes and notices

We may update these Terms to reflect service, provider, security, or legal changes. Material changes will be notified through the service, by email, or by another reasonable method before taking effect. Continued use after the effective date constitutes acceptance; if you do not agree, you must stop using the service.

16. Governing law and jurisdiction

These Terms are governed by Spanish law, excluding conflict-of-law rules. The courts of Barcelona, Spain have exclusive jurisdiction over disputes, unless mandatory law requires otherwise.
